Media Law Expert Faces Backlash Over LinkedIn Meme Strategy

Mark Stephens CBE, a prominent figure in media law, has recently encountered criticism for his social media strategy, particularly on LinkedIn. Known for representing high profile clients such as Mike Tyson and Julian Assange, Stephens has adapted his approach to the evolving media landscape.

In an effort to engage with audiences, Stephens has taken to curating and sharing content from Elon Musk's platform X, previously known as Twitter. This strategy has helped him amass over 33,000 followers on LinkedIn. However, it has also raised questions regarding attribution and the ethical implications of his posts.

Last week, Stephens posted a message on LinkedIn regarding the announcement of a replacement for Jason Arday at Cambridge University, accompanied by a photo of Meghan Markle. This post, which has since been deleted, was noted by the legal news outlet RollOnFriday, which captured a screenshot before its removal.

The post drew attention due to its timing and content, particularly in light of Stephens' previous remarks about the media's coverage of Arday's tragic death. He had previously expressed concerns about the ethical responsibilities of editors in reporting on vulnerable individuals.

In response to the backlash, Stephens stated that his post was intended to highlight perceived racial biases in media coverage, rather than to disparage either Arday or Markle. He expressed regret that the message was misinterpreted and clarified his intent in a lengthy statement.

Stephens further elaborated on his social media philosophy, asserting that the sharing of ideas and humour is a vital aspect of public discourse. He argued that while attribution is important for fairness, copyright law protects original expressions rather than the ideas themselves. He acknowledged the complexities of tracing the original sources of online content, given the nature of social media.

This incident raises important considerations for legal professionals regarding the use of social media as a tool for engagement, the necessity of clear attribution, and the potential repercussions of content sharing in a rapidly changing media environment.
