New Lord Chancellor Sworn In as Legal Year Commences

1st October marks the beginning of the legal year in the UK, coinciding with the swearing in of Alex Norris as the new Lord Chancellor. This event follows a year that saw a change in leadership, with Norris succeeding David Lammy.

The commencement of the Michaelmas term, the first of four traditional court terms, was celebrated with a service at Westminster Abbey attended by high court judges, King's Counsel, and members of the legal community. Norris, who was appointed in July, led the ceremony alongside Lady Chief Justice Baroness Carr.

Norris's swearing in took place at the Royal Courts of Justice shortly before the Abbey service. During this formal occasion, he took an oath to uphold the rule of law and the independence of the judiciary, a practice that reflects the constitutional relationship between the political office and the judiciary.

In his address, Norris expressed his strong belief in institutions and his commitment to actively defending the rule of law. His remarks come amid ongoing scrutiny of the judiciary, particularly following criticisms from figures such as former Shadow Lord Chancellor Robert Jenrick, who has publicly condemned what he describes as activist judges.

As Lord Chancellor, Norris faces immediate challenges, including addressing overcrowded prisons and managing pressures regarding the early release of serious offenders. He has announced plans for accelerated funding for prison construction initiated under the previous administration and is considering the deportation of foreign offenders to free up prison spaces.

Another significant issue on the horizon is the proposed limits on jury sizes in certain criminal cases, aimed at alleviating the backlog in the courts. This matter is set to return to Parliament in October as part of the Courts and Tribunals Bill, although Norris has not yet publicly addressed this contentious topic.

The new legal year begins shortly after the Labour Party Conference, where the Justice Secretary referenced the need for a tough stance on crime, evoking the policies of the Blair Government in the 1990s. He also highlighted Labour's commitment to advancing the 'Hillsborough Law', which is currently progressing through Parliament.

Norris's appointment is notable as he is the first non lawyer Lord Chancellor in a Labour cabinet, joining a small group of non legally qualified individuals who have held this position, all of whom have been from the Conservative Party in recent history.

As the legal community prepares for another demanding year, practitioners are likely to face challenges related to client expectations, court congestion, and the evolving landscape of legal practice influenced by advancements in artificial intelligence.
